This DMCA / Copyright Policy describes how Swiff It (“we,” “us,” or “our”) handles claims of copyright infringement on our platform at swiff.it (the “Service”), in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Our Commitment

Swiff It respects the intellectual property rights of others and expects our users to do the same. We will respond to clear notices of alleged copyright infringement in accordance with the DMCA and will take appropriate action, including removing or disabling access to material that is claimed to be infringing.

Copyright infringement on Swiff It may include, but is not limited to:

  • Uploading resumes, cover letters, or other documents that contain copyrighted content belonging to another party without authorization.
  • Using copyrighted resume templates, designs, or layouts without proper licensing or permission.
  • Reproducing or distributing copyrighted career content, guides, or materials through the Service.

3. Filing a DMCA Notice

If you believe that your copyrighted work has been used on Swiff It in a way that constitutes infringement, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following:

  • Physical or electronic signature: A signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  • Identification of infringing material: A description of where the allegedly infringing material is located on the Service, with enough detail to allow us to find it (e.g., URLs, account identifiers).
  • Contact information: Your name, address, telephone number, and email address so we can contact you regarding your complaint.
  • Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original DMCA notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access or terminate the account of any user who has been the subject of multiple DMCA notices, regardless of whether a formal determination of infringement has been made.

We reserve the right to remove or disable access to any content that we believe in good faith infringes upon the copyright of others, even in the absence of a formal DMCA notice. We also reserve the right to take action against users who file fraudulent or bad-faith DMCA notices or counter-notifications.

Swiff It is a platform that allows users to upload and enhance their own resumes and career documents. We are not the author of user-uploaded content and do not pre-screen materials for copyright compliance. We rely on the DMCA notice-and-takedown process to address infringement claims and act promptly when valid notices are received.

We may update this DMCA / Copyright Policy from time to time to reflect changes in our practices or in applicable law. If we make material changes, we will update the effective date at the top of this page.
