Swiff It is built on honesty, fairness, and respect for your career.

1. Service Description

Swiff It is an AI-powered resume enhancement platform. We analyze your resume against job descriptions and provide optimizations to improve your match score and ATS (Applicant Tracking System) compatibility. The Service also includes recruiter heatmap analysis, multi-ATS simulation, salary insights, application tracking, and document generation.

2. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to create an account.
• One person or entity may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

3. Your Responsibilities

• You are responsible for reviewing all AI-generated enhancements before using them. Items flagged as “Verify” require your confirmation of accuracy.
• You must not upload resumes containing false credentials, fabricated experience, or intentionally misleading information.
• You are solely responsible for the content of resumes you submit to employers, whether or not they were enhanced by the Service.

4. AI Limitations

Our AI enhances the presentation of your experience — it does not fabricate experience, credentials, or qualifications. However, you should be aware of the following:

• AI can make errors. Always review the output before using it.
• Changes marked with “Verify” confidence should be confirmed for accuracy.
• ATS scores and recruiter heatmaps are simulations based on known patterns — they do not guarantee how any specific ATS or recruiter will evaluate your resume.
• Salary insights are estimates based on market data and should not be treated as offers or guarantees.

5. Intellectual Property

• Your content: You retain all ownership rights to the resumes and content you upload. We do not claim ownership of your data.
• Our service: The Swiff It platform, including its design, code, AI prompts, scoring algorithms, and templates, is our intellectual property and is protected by copyright and other laws.
• License to us: By uploading content, you grant us a limited license to process it solely for the purpose of providing the Service. This license terminates when you delete your data or account.

6. Free Tier

• Free accounts receive 1 resume enhancement per rolling 7-day window. Your first enhancement is always free.
• Free access may be limited or modified during periods of high demand.
• We reserve the right to change the free tier limits at any time with reasonable notice.

7. Pro Subscription

• Pro subscriptions are billed monthly or annually via Stripe. Prices are displayed at the time of purchase.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You can cancel anytime from your account settings. Access continues until the end of the current billing period.
• Refunds are handled on a case-by-case basis within the first 7 days of a new subscription. After 7 days, no refunds are provided for the current billing period.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price increase takes effect.

8. Acceptable Use

You may not use Swiff It to:

• Generate resumes with fabricated or intentionally misleading content.
• Abuse the API through automated access, scraping, or rate-limit circumvention.
• Reverse-engineer, decompile, or attempt to extract our AI prompts, scoring algorithms, or source code.
• Resell, redistribute, or white-label the Service without written permission.
• Use the Service in any way that violates applicable laws or regulations.
• Transmit viruses, malware, or any other harmful code through file uploads.

9. Termination

• You may delete your account and all data at any time from Settings.
• We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable.
• Upon termination, your right to use the Service ceases immediately. Data deletion follows our retention policy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFFIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, or goodwill arising from your use of the Service.
• Any decisions made based on AI-generated suggestions, including job applications, interview outcomes, or employment decisions.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Swiff It from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you may delete your account.
